Court extends injunction restraining defamation against Salleh

KUALA LUMPUR, July 13 (Bernama) -- The High Court here today extended the interim injunction granted to National Feedlot Corporation Sdn Bhd (NFCorp) chairman Datuk Seri Dr Mohamad Salleh Ismail restraining former consultant Datuk Shamsubahrin Ismail from republishing defamatory statements against him.

In extending the interim injunction, Judicial Commissioner Datuk Mohd Zaki Abdul Wahab set July 27 to hear Mohamad Salleh's application for the injunction. On July 8, Mohd Zaki had issued a five-day order against Shamsubahrin to prevent him from repeating alleged defamation linked to his Facebook postings

On July 3, Mohamad Salleh sued Shamsubahrin for allegedly posting defamatory remarks on his (Shamsubahrain) Facebook account.

In the statement of claim, Mohamad Salleh stated that Shamsubahrin had uploaded six statements containing defamatory words against him (Mohamad Salleh) on a Facebook account belonging to Shamsubahrin Ismail Tom between last May 19 and June 23 this year which could be access by the public.

Mohamad Salleh claimed the statements were posted after Shamsubahrin was sentenced to eight years' jail and four strokes of the cane by the Sessions Court last May 18 for cheating and money laundering.

He stated that Shamsubahrin had claimed being made a scapegoat and was convicted for the offences by the court as a way for Prime Minister Datuk Seri Najib Razak and the Malaysian government to protect him (Mohamad Salleh), as well as to enable the Attorney-General to drop the charges for criminal breach of trust facing the plaintiff.

Mohamad Salleh claimed that the defamatory words implied that he had colluded with his wife, Datuk Seri Shahrizat Abdul Jalil, to influence Sessions Court judge Rozilah Salleh to convict Shamsubahrin.

He said the words also implied that he had influenced the police, the Malaysian Anti-Corruption commission and the Attorney-General Chambers to not take legal action against him.

He is seeking general and aggravated damages, cost and orders deemed fit by the court, as well as an injunction to prevent Shamsubahrin or his agents from further publishing the alleged defamatory words Mohamad Salleh is represented by lawyers Al Firdaus Shahrul Naing and Syed Ismat Syed Muhamad, while lawyer Zarina Ismail represented Shamsubahrin.
